PEOPLE
OF THE PHILIPPINES,
- versus - O R D E R The Order of this Court of even date is hereby modified to the effect that the Prosecutors in these cases probably did not know that the photographs of the face of that corpse found in Site Tan-awan, Carcar, Cebu existed, hence, they did not willfully suppress presentation of such photographs in evidence. Nevertheless, the Court reiterates its findings that such facial photographs were undoubtedly taken - it defies logic that the police took photographs of everything about the corpse except its face- but that the police investigators chose not to turn over such facial photos to the Prosecutors presentation to this Court, hence, the police were the ones who willfully suppressed presentation of such facial photographs in evidence - for obvious reason that the same were not those of the face of the kidnapped victim Marijoy Chiong. SO ORDERED. Given in chambers this 13th day of May at Cebu City, Philippines
